Terms of Service

These Terms of Service ("Terms") govern your use of AfterShifts, a service that automates review-request messaging for local service businesses, operated by Colin Ferrell, doing business as AfterShifts ("we," "us," "our"). By signing up for or using AfterShifts, you ("Client," "you") agree to these Terms.

1. The Service

AfterShifts sends automated SMS messages to your customers ("End Users") after a completed job, requesting a Google review. End Users who reply positively receive a direct link to leave a review. End Users who reply with a negative or critical message are routed to you directly, so you may address the concern before it becomes a public review.

2. Your Responsibilities as a Client

By submitting an End User's contact information to AfterShifts, you represent and warrant that:

• You have an existing business relationship with the End User (they are your customer).
• You have obtained appropriate consent from the End User to be contacted by SMS regarding their service, including review requests.
• The information you submit (name, phone number, job details) is accurate.
• You will not use AfterShifts to send messages to individuals who have not consented to be contacted, or for any unlawful, harassing, or deceptive purpose.

You are responsible for ensuring your own business practices, including any privacy policy or customer-facing disclosures, are consistent with your use of automated SMS messaging through a third-party service like AfterShifts.

3. Subscription and Payment

• AfterShifts is billed monthly at the rate displayed at signup.
• There is no long-term contract. You may cancel at any time, effective at the end of your current billing period.
• We may offer a free trial period; if you do not cancel before the trial ends, you will be charged the standard subscription rate.
• Fees are non-refundable except where required by law.

4. Acceptable Use

You agree not to use AfterShifts to:

• Send messages to phone numbers obtained without consent.
• Send content that is false, misleading, harassing, or unrelated to the service you provided.
• Attempt to manipulate or incentivize reviews in violation of Google's review policies or applicable law.
• Interfere with or disrupt the operation of the service.

We reserve the right to suspend or terminate any account that violates these Terms, including any account associated with a pattern of consumer complaints or carrier filtering.

5. Message Delivery

We rely on third-party providers, including Twilio, to deliver SMS messages. While we make reasonable efforts to ensure messages are sent promptly, we do not guarantee delivery, as message transmission can be affected by carrier filtering, network issues, or other factors outside our control.

7. Limitation of Liability

To the maximum extent permitted by law, AfterShifts and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue or business, arising from your use of the service. Our total liability for any claim related to AfterShifts will not exceed the amount you paid us in the three months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless AfterShifts and its operator from any claims, damages, or expenses arising from your breach of these Terms, including claims arising from messages sent to End Users without proper consent.

9. Termination

You may cancel your subscription at any time. We may suspend or terminate your access to AfterShifts if you violate these Terms, fail to pay applicable fees, or use the service in a way that creates legal or carrier compliance risk for us.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of AfterShifts after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles.
